Terms of service

Terms of Service

Last updated: 18 August 2026

These Terms of Service apply when you access the Safira Jewellery website or purchase from us. By placing an order, you agree to these terms. References to 'we', 'us' and 'our' mean Safira Jewellery, operated by Juliana Giovanella Zanelato, sole trader (NZBN 9429049587937).

Eligibility and acceptable use

You must have legal capacity to enter into a contract or have the permission of a parent or guardian. You must not misuse the website, interfere with its security, introduce malicious code, scrape it unlawfully, infringe intellectual property rights or use it for unlawful or fraudulent purposes.

Product information and care

We take reasonable care to describe and photograph products accurately, including materials, finish, dimensions and available variants. Colours and scale may appear differently depending on screens and photography. Natural wear, finish changes and durability depend on use, storage, exposure to chemicals, moisture and compliance with care instructions. Nothing in this clause limits the requirement that products match their description and be of acceptable quality under New Zealand law.

Pricing and GST

Prices are displayed in New Zealand dollars. Safira Jewellery is not currently registered for GST, so prices do not include a separately charged GST amount. Shipping charges and any other applicable fees are shown before you complete payment. We may change prices prospectively, but changes will not affect an order already accepted.

Orders and acceptance

Submitting an order is an offer to purchase. An automated acknowledgement does not necessarily mean the order has been accepted. We may decline or cancel an order before dispatch where, for example, the product is unavailable, there is an obvious pricing or description error, payment is not authorised, fraud is suspected, or we cannot deliver to the supplied address. If we cancel after payment, we will refund the amount paid for the cancelled item or order.

Stock and product limits

All products are subject to availability. We will not advertise an item as available unless we have a reasonable basis to believe we can supply it on the stated terms. We may apply reasonable purchase limits to protect stock availability or prevent suspected resale or fraud.

Payment

Payment is processed through the payment options displayed at checkout, including Shopify Payments and PayPal where available. Your use of a payment provider may also be subject to that provider's terms and privacy practices. You authorise the payment provider to charge the amount confirmed at checkout.

Shipping, returns and cancellations

Our Shipping Policy, Returns & Exchanges Policy, Cancellation Policy and Earring Hygiene Policy form part of these terms.

Intellectual property

The Safira Jewellery name, branding, website content, product copy, photographs, graphics and other materials are owned by or licensed to us and are protected by applicable intellectual property laws. You may view and use the website for personal shopping purposes but may not reproduce, distribute or commercially exploit the content without permission.

Reviews and submitted content

If you submit a review, photograph or other content, you confirm that it is accurate, lawful and does not infringe another person's rights. Unless we agree otherwise, you grant us a non-exclusive, royalty-free licence to display and use that content for operating and promoting Safira Jewellery. We will handle personal information in accordance with our Privacy Policy.

Third-party services and links

The website may use or link to third-party services. We are not responsible for third-party content or services outside our reasonable control, but nothing in this clause limits responsibility that cannot lawfully be excluded.

Consumer rights and liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or any other law that cannot lawfully be excluded. To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable or that result from your misuse, unauthorised alteration or failure to follow reasonable care instructions.

Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, but we will take reasonable steps to communicate, minimise disruption and meet any obligations that continue to apply under New Zealand law.

Changes to these terms

We may update these terms from time to time. The version published when you place an order will apply to that order unless a change is required by law or agreed with you.

Commercial Warranty

Safira Jewellery does not currently offer a separate, time-limited commercial or extended warranty in addition to the rights provided by New Zealand law.

All products remain covered by the Consumer Guarantees Act 1993, including guarantees that goods are of acceptable quality, fit for purpose and match their description. These statutory rights apply for a reasonable period having regard to the nature and price of the product and cannot be reduced to an arbitrary fixed warranty period.

Normal wear, accidental damage, misuse, unauthorised alteration, or damage caused by failure to follow reasonable jewellery care instructions may not be a product failure under the Act. Each claim will be assessed fairly based on the circumstances and legal requirements.

Governing law and contact

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction. Contact us at support@safirajewellery.co.nz or by post at 3/5 Ayr Road, Pakuranga, Auckland 2010, New Zealand.
